Kate Cunningham

Kate has broad property, commercial and estate planning experience spanning 20 years in Sydney and Orange, both in private practice, government and in house at Australia’s largest hotel operator.

Kate’s property and commercial experience includes advising on a range of transactions, including acquisitions and disposals of land and businesses, leasing, shareholder’s agreements, joint ventures and partnerships and option agreements. Kate is also experienced in providing advice on property issues such as easements, possessory title, and restrictions on the use of land, including in acting for landowners in solar farm and wind farm developments. Her clients include landowners, developers, government departments, purchasers and tenants.

Kate has broad estate planning experience, ranging from simple Wills to preparation of and advice on family trusts, self-managed super funds and intergenerational land transfers. Her extensive real property and commercial experience is an advantage in an area that is often complicated by complex ownership structures. She is able to explain the issues that arise in Estate Planning to assist clients to establish a plan that best meets their objectives, frequently collaborating with accountants and financial planners. She is currently studying her Master of Laws majoring in Estate Planning.

An important part of Kate’s role is understanding what drives transactions so that her clients receive strategic and commercial advice to deliver desired outcomes, while recognising the legal and commercial risks and benefits and not spending time and money on unnecessary negotiations.

Before Whiteleys

Kate spent many years working in a top-tier national law firm, where her practices concentrated on real estate and commercial transactions. She then took an in-house role at Australia’s largest hotel operator, working on a vast array of transactions across the hospitality industry.

When Kate relocated to Orange 4 years ago, she took a legal role with a NSW government department, where she was fortunate to have gained invaluable experience in regional projects in the water space. This includes being involved in the development and negotiation of funding agreements, advice relating to compulsory access to land and water access licences, and complex procurement and property transactions. Kate is well placed to advise rural landholders and businesses on these issues.

Kate is an avid reader, loves hiking in faraway places with her husband Dan and attempting to grow vegetables in her garden.
