We understand that commercially it is best to settle disputes amicably, containing legal costs, and preserving relationships. We view litigation as very much a last resort and try any means possible to avoid it.

• successfully representing a client in having an injunction awarded against a competitor for infringement of a trade mark;

• successful proceedings in the District Court of New South Wales over the correct interpretation of a contract, and successfully defending an appeal of the decision in the Supreme Court of New South Wales, Court of Appeal;

• acting for both executors and claimants in claims made for further provision out of a will pursuant to the Succession Act 2006 (NSW);

• acting in respect of a claim made under the Property (Relationships) Act 1984 NSW;

• making an application under the Corporations Act 2001 Cth for the distribution of excess funds held by the liquidator to the company’s shareholders, and having the company returned to their control;

• bringing proceedings for misleading and deceptive conduct, and pursuant to the Sale of Goods Act 1923NSW for damages for misdescribed goods;

• acting in a professional negligence claim against a registered valuer in respect of the purchase of a motel business; and

• pursuing unpaid rent in respect of local commercial premises in various courts, including the Local, District and Supreme Courts.
